By accessing, browsing, or using the Hygenx website, mobile application, or any associated services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). We reserve the right to update these Terms at any time without prior notice, and your continued use of the Services following any changes constitutes your acceptance of the revised Terms.

2. Order Acceptance and Processing

All orders placed through our Services are subject to acceptance and availability. We reserve the absolute and sole discretion to refuse, cancel, or limit any order for any reason whatsoever, including but not limited to product availability, errors in product or pricing information, suspected fraudulent activity, or any other reason we deem necessary. All sales are final and non-refundable except in cases where products arrive damaged or defective through no fault of the purchaser. All cosmetic products sold by Hygenx are intended for external use only. You acknowledge and agree that you are solely responsible for reviewing all product ingredients prior to use and determining whether you have any allergies, sensitivities, or other conditions that would make use of our products inappropriate or potentially harmful. We make no representations or warranties regarding the suitability of our products for any particular skin type, condition, or individual. Product colors, textures, and appearances may vary from photographs and descriptions shown on our Services due to monitor settings, lighting conditions, and other factors beyond our control.

4. Shipping and Risk of Loss

Shipping and handling charges are non-refundable and will be calculated and displayed at checkout. All merchandise is shipped FOB origin, and title and risk of loss pass to you upon delivery to the common carrier. We are not responsible for any delays, loss, or damage that occurs after products have been delivered to the shipping carrier. International customers are solely responsible for any and all customs duties, import taxes, brokerage fees, and other charges imposed by their country of import. We have no control over these charges and cannot predict their amount.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HYGENX, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OUR PRODUCTS OR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT THAT GAVE RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Hygenx and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including attorney's fees) arising from: (i) your use of our products or Services; (ii) your violation of these Terms; (iii) your violation of any third party rights; or (iv) any harm caused to any third party related to your use of our products.
